TIGER UNIVERSITY VIDEO CONTEST

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCE OF WINNING. These are the official rules ("Official Rules") for the TigerDirect University Video Contest (the "Contest").

CONTEST DESCRIPTION AND TIMING: Entrants are asked to produce and submit a video (maximum of ninety seconds) depicting what he/she would resort to in order to win an Intel PC (see Video Requirements section below). The Contest begins on 11:00 AM ET 09/04/07 and ends at 12:00 PM (noon) ET on 10/02/07 (the "Contest Period").

  1. Eligibility: Sweepstakes is offered only in the United States to legal United States residents at least 18 years old. Employees and directors of TigerDirect.com, ("Sponsor"), participating prize provider(s), their parents, affiliated and subsidiary companies and their advertising and promotional agencies and the immediate family (spouse, mother, father, sister, brother, daughter or son, regardless of where they live) or members of the households of such employees and directors (whether or not related) are not eligible. By entering, you agree to these Official Rules and the decisions of Sponsor, which are final and binding in all respects. Void where prohibited.
  2. Email: Should you access the TigerDirect.com web site to participate in this Contest by clicking on an icon or other link on another web site, by submitting the registration form and acknowledging receipt of the confirmation email you will opt-in to receive email or other communications from TigerDirect.com and its affiliated partners. You may subsequently opt-out of the receipt of such email or communications by following the directions in the email or contacting that site. Your opt-out status will not affect your participation or chance to win in this Contest. During the Promotional Period, however, you may nevertheless receive emails which TigerDirect deems are related to the Contest and related programs.
  3. Promotional Period: Promotion begins on September 04, 2007 at 11am Eastern Time (EST), and ends on October 02, 2007 at 12:00:00 a.m. (EST) ("Promotional Period").
  4. Entry: Access the TigerDirect.com web site at www.tigerdirect.com, either directly or by clicking on the icons, banners, text links, or other advertising on TigerDirect's partner web sites. For one entry into the Contest, simply complete the Contest registration form and hit the submit button. All entries must be complete with your legal name, zip code, email address and YouTube Video URL. By registering you agree that you would like to receive more information about TigerDirect.com and its affiliated partners. (You may opt-out of the receipt of such information at anytime by following the instructions in the email or as indicated on the web site). You need enter only once per video by accessing the web site and following the Contest directions. Each entry must include a unique email address. Entries must be received and recorded by Sponsor's computer by 12:00:00pm (noon) August 6, 2007(ET). Any other attempt at Internet or email entry is void. Limit one entry per email address.

    5. LIMITS: Entrants may submit multiple entries; however, all entries must (a) be submitted separately, (b) be significantly different from other entry/entries submitted by a single entrant, (c) must include the completion and acceptance of the Official Entry Form, and (d) must include a unique and valid email address. We cannot accept multiple entries with the same email address. However, individuals are allowed to enter each distinct video with different email addresses. An entry must be created solely by one person; joint/group entries are NOT allowed. In the event of a dispute, Entries will be deemed made by the authorized account holder of the email address submitted at the time of Entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, on-line service provider, or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. Potential winners may be required to show proof of being the authorized account holder.

    VIDEO REQUIREMENTS: Entries must meet the following requirements to be eligible for judging:

    1. Must be a movie with a total running time of ninety (90) seconds or less;
    2. Must comply with standard video upload requirements available at youtube.com
    3. Movies may be in color or black and white;
    4. No music tracks allowed.
    5. Entry must not violate third party rights including, but not limited to: copyrights, trademark, and right of publicity. Do not show and 3rd party trademarks, company names, or logos.
    6. Entries must not include unsuitable content or depict or incorporate: unsafe behavior or situations; obscenity; disparagement of any product or person; or other offensive conduct or material, or otherwise include inappropriate content.
    7. By submitting the video you agree that TigerDirect has the unrestricted right to: use your video Entry in whole or in part, commercially or non-commercially, in any media, in perpetuity worldwide, including the right to publish and display the video Entry for advertising and publicity, and to edit and make derivative works, all without additional review or compensation.
    8. All videos must be posted on YouTube.com
    Videos will be ineligible if, as determined by Sponsor or judges (in the sole discretion of either party), they are corrupted, do not meet ALL of the above specified requirements or are not able to be viewed due to technical error or reasons beyond the control of the Sponsor or the judges. In addition, a video shall be void if it includes any endorsements or so-called "commercial tie-ins" of TigerDirect or Intel's competitors, or if it contains any material which Sponsor or judges in their sole discretion deems patently offensive such as profanity, violence or nudity, or which might subject Sponsor or its licensees to public disrepute or otherwise compromise the goodwill of Sponsor or its licensees, unfavorable regulatory action, violate any law, infringe the rights of any person, or subject Sponsor or its Licensees to liability for any reason. By submitting an Entry: Entrant represents and warrants that Entry is wholly original (DO NOT COPY THE WORKS OF OTHERS), not previously submitted, distributed or aired on the internet or elsewhere for any other purpose and once submitted will not be used by Entrant or any other person for any other purpose, and does not incorporate or include anything that is owned by any third party or would require the consent of any third party and your Entry does not violate any copyright, trademark, publicity right, privacy right or any other right of any third party. No responsibility is assumed for lost, late, incomplete, stolen, misdirected, or illegible entries or email; or for any computer, telephone, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, availability or garbled or jumbled transmissions, service provider/Internet/web site/use net accessibility or availability, traffic congestion, or technical failures, or unauthorized human intervention, or the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information.
  5. FINALISTS: Judges will select thirty (30) or more finalists from all eligible entries received throughout the contest. Finalists will be selected based on originality, creativity, popularity on YouTube.com, and adherence to the rules.
  6. WINNERS: Judges will select three (3) winners amongst the thirty or more finalists. The Grand Prize Winner will be the finalist with the most views on YouTube.com. The Second (2nd) Prize Winner will be the finalist with the second most views on YouTube.com. The Third (3rd) Prize Winner will be the finalist with the third most views on YouTube.com. Most views on YouTube.com will be determined by the judges on or around September 5th, 2007. TigerDirect.com reserves the right to disqualify a video at their sole discretion with excessive views caused by robots or other automated methods of generating false views.
  7. Prize/Odds:

    GRAND PRIZE:

    (1) Systemax Sabre Gaming PC with an estimated value of $5,000.00 will be given away or
    (2) $5,000 Cash or
    (3) a TigerDirect.com $5,000 Gift Card.

    Odds of winning will depend upon the number eligible entries received. Void where prohibited by law.

  8. General Conditions: Within 24 hours of the judges' selections, winners' names will be posted on the TigerDirect.com website and the winners will be contacted via email. The winners have 48 hours to respond to the email in order to claim the prize, otherwise an alternate winner will be selected. Winners will be required to complete, execute and return an Affidavit of Eligibility, a Liability Release, and where lawful, a Publicity Release within 10 business days of responding to the prize notification. Failure to return documents timely, or if prize notification or prize is returned as non-deliverable, or if winner is found not to be eligible or not in compliance with these Official Rules, disqualification will result. By accepting prize, where permitted by law, winners grant to Sponsor, and those acting pursuant to Sponsor's authority (and agree to confirm said grant in writing) the right to use and publish his/her name, portrait, picture, submitted videos, voice and likeness for advertising, trade and promotional purposes without additional consideration, worldwide, and on the World Wide Web, without notification, review or approval. Further, participants release and agree to hold harmless Sponsor, its parents, affiliates, subsidiary companies, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injury, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the prize, participation in any Contest related activity, or participation in this Contest.

    Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the contest or web site; to be acting in violation of the Official Rules; to be acting in violation of the terms of the web site, or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, programmed or the like entry methods or view methods will void all such entries by such methods, and disqualify any entrant using any such method. In the event of a dispute as to entries submitted by multiple users having the same email account, the authorized subscriber of the email account used to enter the Contest at the actual time of entry will be deemed to be the participant and must comply with these rules. Authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet access provider, on-line service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted email address.
  9. Limitations of Liability: Sponsor is not responsible for any incorrect or inaccurate information, whether caused by web site users, tampering or by any of the equipment or programming associated with or utilized in the Sweepstakes and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access the web site. Sponsor is not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading or copying materials from or use of the web site. If, for any reason, the Sweepstakes or a drawing is not capable of running as planned by reason of infection by computer virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of Sponsor, may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes, or drawing, and select the winner(s) for the Sweepstakes, or for such drawing, from entries received prior to the action taken or in such other manner as deemed fair and appropriate by Sponsor.   10. Choice of Law:Except where prohibited, entrants agree that any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys' fees; and under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Florida, without regard for conflicts of law doctrine, and all proceedings shall take place in Dade County, FL.
